RILEY, WHO HAS A, A FEW THINGS THAT HE WOULD LIKE TO DISCUSS WITH US. ANYTHING THAT THE TOM BOARD WOULD LIKE TO, TO START WITH. I DO HAVE A LETTER FROM THE, UM, PRESERVATIVE HISTORIC PRESERVATION ADVISORY BOARD. THEY'VE BEEN WORKING ON THIS FOR A WHILE, AND THEY ASK THAT I SHARE IT AT THE WORK SESSION, SO I'LL JUST KIND OF PASS IT THIS WAY. THANK YOU. AND IT HAS TO DO WITH, UM, THEY HAVE IDENTIFIED THE BAYVIEW HOTEL AS THE FIRST HISTORIC LANDMARK IS THEY ARE SEEKING DESIGNATION FOR, AND SO THIS IS A LETTER FROM THE COMMITTEE CHAIR, MR. JACK SSON. MANY OF YOU'RE QUITE FAMILIAR WITH MR. SSON. HE'S NOW CHAIR OF THE SERVE PRESERVATION ADVISORY BOARD. AND, UM, THE LETTER FROM HIM OUTLINING, UH, WHAT IT IS THAT THE, UH, PRESERVATION ADVISORY BOARD WOULD LIKE THE, THE TOWN BOARD TO CONSIDER IN TERMS OF DESIGNATION OF THE BAYVIEW HOTEL AS A HISTORIC . OKAY. ANY QUESTIONS OR DISCUSSION ON THE LETTER? I KNOW THAT THE HISTORIC PRESERVATION, UH, UH, BOARD IS, IS A RELATIVELY NEW LOCAL LAW FOR, FOR HAMBURG. CORRECT. UM, WHAT, WHAT WOULD GO ALONG WITH THIS, THIS DESIGNATION? AND DID THEY HAVE ANY OPPORTUNITY TO TALK TO THE, THE CURRENT OWNER? IS THAT PART OF THE PROCESS? IT'S PART OF THE PROCESS, AND I KNOW MR. WALLING HAS WORKED WITH THE GROUP, UM, EVEN LONGER THAN I'VE BEEN INVOLVED IN. HE WAS ACTUALLY, UH, VERY MUCH INVOLVED IN CRAFTING THAT, THAT LOSS. SO, SO MAYBE YOU COULD ANSWER SOME OF THESE QUESTIONS. RIGHT. I THINK PROBABLY I SHOULD. UM, SO WE HAVE A VERY BARE BONES LAW. IT, WE HAVE A HISTORIC PRESERVATION ADVISORY BOARD. UM, SO IF YOU LOOK AT WHAT THE VILLAGE OF HAMBURG HAS, THEY HAVE A COMPLETELY DIFFERENT LAW. THEY HAVE A HISTORIC PRESERVATION COMMISSION WITH A VERY ELABORATE LAW THAT SETS FORTH ALL THESE POWERS THAT THE COMMISSION HAS. BASICALLY, THE VILLAGE OF HAMBURG HAS DELEGATED ALL KINDS OF RESPONSIBILITY TO THIS BOARD, TO NOT JUST, UH, IDENTIFY PROPERTIES THAT NEED TO BE PRESERVED. LANDMARKED IS THE TERM, BUT THEY ALSO HAVE DELEGATED THE AUTHORITY TO DO THE, DO THE DESIGNATION. AND THEN AFTER THEIR DESIGNATION HAPPENS, THEN THE PROPERTY OWNER WOULD, IF THEY, IF THEY THINK THERE'S A HARDSHIP IN THEM BEING LANDMARKED, THEY HAVE TO GO TO THE, TO THIS BOARD, TO THIS COMMISSION, TO, TO GET, UH, AUTHORITY FROM THE COMMISSION, NOT FROM THE VILLAGE TRUSTEES, BUT FROM THE COMMISSION ITSELF TO, TO HAVE AN EXCEPTION TO THE LANDMARKING. UM, IF, IF THE, UM, OWNER WANTS TO GET A DEMOLITION PERMIT OR KNOCK DOWN PART OF THE BUILDING, THEY HAVE TO GO TO THE COMMISSION. THEY DON'T GO TO THE VILLAGE TRUSTEES. AND THERE'S ALL THESE HEARING PROCESS, THERE'S AN APPEAL PROCESS, BUT THE APPEAL IS TO THE VILLAGE TRUSTEES. WE DON'T HAVE ANYTHING LIKE THAT AT THE TIME OF HEBER. WE JUST HAVE A COMMISSION THAT MAKES RECOMMENDATIONS. WE DON'T HAVE ANY PROCESS FOR ACTUALLY HAVING EITHER THE VILLAGE BOARD OR ANY OTHER BODY, UH, GIVEN AUTHORITY TO DO THE LANDMARK. SO IT'S, IF, IF THIS IS GOING TO HAPPEN THERE, THIS BOARD HAS TO PASS, UH, A LOCAL LAW THAT EITHER GIVES ITSELF THE AUTHORITY TO DO THE LANDMARKING AND, AND HAVE [00:10:01] ALL THOSE DECISIONS MADE BY THIS BOARD ITSELF, OR IT HAS TO DELEGATE THAT THIS BOARD COULD DELEGATE IT TO THE COMMITTEE. BUT IN ORDER TO DO SO, IT WOULD HAVE TO MAKE THIS COMMITTEE INTO MORE THAN JUST AN ADVISORY COMMITTEE. IT WOULD HAVE TO MAKE IT LOOK LIKE WHAT THE VILLAGE HAS. SO BEFORE, UH, IF THERE CAN BE ANY REAL PROGRESS ON THIS LANDMARKING OF ANY PROPERTY, INCLUDING, UH, THAT PROPERTY THAT THEY WANT TO LANDMARK, WE HAVE TO HAVE A, A LEGISLATIVE STRUCTURE IN PLACE. SO, SO THAT'S REALLY HAS TO, HAS TO HAPPEN FIRST. AND, AND THE, THE, UM, ADVISORY, UH, BOARD, THEY'RE AWARE OF THAT. THE COMMITTEE'S AWARE OF THAT. THEY'RE AWARE THAT, OKAY, THAT WE, THEY, WE, WE HAVE A, THEY CAN MAKE A RECOMMENDATION, BUT THE RECOMME FOR THE RECOMMENDATIONS, THEY ACTUALLY AMOUNT TO ANYTHING. THIS BOARD HAS TO PASS THE LOCAL LAW AND BACK TO YOUR, SO THAT'S THE DECISION THAT YOU HAVE TO MAKE AS A GROUP. DO YOU WANT TO HANDLE THE LANDMARKING YOURSELVES OR DO YOU WANT TO DELEGATE THAT TO THIS, UM, TO THIS, UH, ADVISORY COMMITTEE AND MAKE IT INTO MORE THAN JUST AN ADVISORY COMMITTEE? AND BACK TO YOUR ORIGINAL QUESTION, THAT WAS SOMETHING THAT THE ADVISORY BOARD ACTUALLY JUST DISCUSSED AT THEIR LAST MEETING. THE WHOLE IDEA OF, UM, THE, THE DUE PROCESS. IN OTHER WORDS, THAT PROCESS IS VERY IMPORTANT. AND PART OF THAT WOULD BE THE DUE PROCESS INVOLVED IN TERMS OF NOTIFICATION TO, UM, BUSINESS OWNERS, BECAUSE YOU WOULD NOT WANT A BUSINESS OWNER TO BE SURPRISED. AND THAT'S, THAT'S AN VERY IMPORTANT PIECE. SO THAT WOULD ALSO BE PART OF THE PROCESS THAT NEEDS TO BE CARVED OUT AND DECIDED UPON. BUT THEY WANTED THEIR, UM, THIS IS THE BAYVIEW SITE IS WHAT THEY'VE IDENTIFIED AS THEIR FIRST, UM, PROJECT, AND THAT MAY EVEN GUIDE THIS PROCESS THAT NEEDS TO, TO EVOLVE. AND THEY IDENTIFIED THIS AS THAT, THAT FIRST PROJECT. AND SO THEY WANTED THEIR INTENT TO TAKE A LOOK AT THIS PROJECT BROUGHT FORWARD TO THE TOWN BOARD. SO THEY'RE NOT EXPECTING ANY IMMEDIATE ACTION, CORRECT? CORRECT. OKAY. THE COMMISSION'S ONLY BEEN IN EXISTENCE FOR LESS THAN A YEAR. UM, AND THIS IS PROBABLY THE OLDEST, UM, BUILDING OUTSIDE OF VILLAGES IN THE ENTIRE, UM, TOWN OF HAMBURG. IS THERE ANY BENEFIT TO THE LANDOWNERS OR THE OWNER OF THE PROPERTY OF EARNING THIS DESIGNATION OF A HISTORIC BUILDING? THERE CAN BE TAX CREDITS THAT THEY CAN GET. SO THERE'S SOME REAL BENEFITS IF, IF THEY, UH, I MEAN, I'M NOT AN EXPERT IN THIS. I DON'T CLAIM TO BE AN EXPERT IN THE TAX CREDITS, THAT'S FOR SURE. BUT IF YOU CAN APPLY FOR TAX CREDITS, IF, IF YOU'VE GOT A, A LANDMARK PROPERTY, I THINK THERE ARE SOME GRANTS THAT ARE AVAILABLE. ALSO, I KNOW THE ADVISORY BOARD TALKED ABOUT, UM, A WHOLE LIST OF WHAT MIGHT BE CONSIDERED TO BE CONSTRAINTS FOR A BUSINESS OWNER IN ADDITION TO WHAT MIGHT BE OPPORTUNITIES SUCH AS POTENTIAL GRANTS OR, OR TAX, UM, INCENTIVES. BUT ALONG WITH THAT, THERE MIGHT BE SOME CONSTRAINTS DEPENDING ON, UM, SOME OF THE, THE, THE, THE DESIGNATION AS A, UH, AS A HISTORIC LANDMARK MIGHT MEAN THAT THERE ARE CERTAIN ALTERATIONS THAT THEY CANNOT MAKE TO THE FACILITY. SO AGAIN, THERE'S BOTH, THERE'S, THERE'S PROS AND CONS. THAT WAS PART OF MY CONCERN. RIGHT? RIGHT. I DIDN'T WANNA STIFLE EX, THAT WAS EXACTLY THE DISCUSSION THAT THE, THAT THE BOARD HAD, WHICH IS WHY THAT IDEA OF, UM, DUE PROCESS AND, YOU KNOW, PROCESS SO THAT LANDOWNERS WOULD, WOULD HAVE PLENTY OF KNOWLEDGE ABOUT WHAT'S DESIGNATED, WHAT'S POTENTIALLY COULD BE DESIGNATED THAT, THAT OF COURSE WOULD BE AN IMPORTANT PART OF THIS PROCESS. AND I, I JUST HAVE TO ADD THAT I AM VERY WELL FAMILIAR WITH THE HISTORICAL NATURE OF, OF THIS PROPERTY BECAUSE I HEARD OFTEN THROUGHOUT MY CHILDHOOD FROM THE PROUD OWNER OF THE SECOND OLDEST CAVERN IN THE TOWN OF HAMBURG, THAT THE BAYVIEW HOTEL WAS THE OLDEST TAVERN IN THE TOWN OF HAMBURG. ANY OTHER QUESTIONS OR THOUGHTS? UM, NO. I MEAN, I GUESS, SO IT'S EITHER WE ARE THE ONES WHO AUTHORIZE OR WE GIVE THE AUTHORITY TO THIS. YOU HAVE TO DECIDE, AND THEN THE LAW WOULD, YOU KNOW, FOLLOW WHAT YOUR DECISION IS. YOU, YOU HAVE TO MAKE A BASIC DECISION. DO YOU WANT TO DO THE LANDMARKING OF ANY PROPERTIES YOURSELF OR DO YOU WANNA DELEGATE THAT TO THIS BOARD AND MAKE IT MORE THAN JUST AN ADVISORY BOARD, THE ADVISOR, THAT'S YOUR BASIC DECISION. RIGHT. THE ADVISORY BOARD ALSO SAID THAT THEY, UM, THEY WANTED THIS PRESENTED THIS EVENING, BUT THEN THEY ALSO WANTED IT COMMUNICATED THAT THEY WOULD BE HAPPY TO BE PRESENT AT A FUTURE MEETING IF YOU FELT IT WOULD BE BENEFICIAL OR HELPFUL TO ACTUALLY MEET WITH THE COMMITTEE, UM, TO HAVE A FURTHER DISCUSSION. UM, WITH ALL THAT INFORMATION, I THINK WE COULD BE FAIRLY EASY FOR US TO MAKE A, A DETERMINATION, BUT I WOULD WANT MORE INFORMATION, MORE FACT GATHERING BEFORE WE COULD DETERMINE WHICH IS GONNA BE THE BEST FOR OUR TOWN. I COULD LOOK INTO THAT. I COULD SEE WHAT THE OTHER TOWNS AND ERIE COUNTY HAVE. I MEAN, THAT VILLAGE IS NOT THE SAME AS, AS A TOWN. I MEAN, IT GOT A LOT OF OLDER PROPERTIES IN A VILLAGE, AND THE CITY OF BUFFALO IS A LOT DIFFERENT FROM THE SUBURBS. MM-HMM . SO, UM, SURE. I COULD LOOK INTO THAT. GREAT. ALRIGHT. THANK YOU. I KEPT THE FEE STRUCTURE THE SAME FOR SMALL PROJECTS IN ADDITIONS, OR IN SOME CASES MAYBE EVEN LESS, ENCOURAGING THE SMALL BUSINESSMEN TO DO SMALL ADDITIONS, ET CETERA, AND NOT PAY A TREMENDOUS AMOUNT OF FEES FOR THOSE. SO I'VE SUGGESTED THAT, BUT PLEASE, WE'RE NOT DOING ANYTHING WITH THEM TONIGHT, BUT REVIEW THEM, CAMMY'S GONNA REVIEW THEM, SARAH'S GONNA REVIEW THEM. ANYBODY ELSE THAT WANTS TO TAKE A LOOK AT THEM, UH, I KNOW YOU TYPICALLY DO DO THIS AT YOUR BOARD MEETING, BUT ANYTIME DURING THE YEAR YOU CAN UPDATE YOUR FEES. THEY HAVE BEEN UPDATED SINCE 2019. UH, BUT IT WILL BE MY UNDERSTANDING, AND YOU'VE HEARD THE ANNOUNCEMENT LIKE I DID, IT'LL BE OWNED BY THE LANDS WILL BE OWNED BY THE STATE OF NEW YORK AND LEASED BACK. SO I'M ASSUMING THEY WILL NOT REQUIRE LOCAL APPROVALS FOR ANY OF THAT SINCE THE LANDS WILL BE OWNED BY THE STATE OF NEW YORK. BUT AS BETH AND I REPORTED IN THE PAPER VERY VEHEMENTLY THAT, UH, THE TOWN OF HAMBURGER AND THE TOWN OF ORCHARD PARK WANT TO BE PART OF THOSE CONVERSATIONS. WE WANNA SIT DOWN AND SUPERVISOR OTHERS SIT DOWN AND TALK TO 'EM ABOUT THE CHANGES IN THE AREA AND WHAT THE LONG TERM IMPACTS ARE TO THE AREA. UM, YOUR HIDA SEAN BROUGHT UP THE FACT THAT MAYBE WE CREATE A, A, UH, UH, AN ENTERTAINMENT DISTRICT, YOU KNOW, IN YOUR OWN TERMS, I MEAN, WHAT YOU WOULD LIKE TO SEE IN THAT AREA. UH, BUT THERE'S OTHER THINGS THAT WHOLE AREA WHERE, UM, WHERE THE, WHERE THE ECC CAMPUS IS NOW, ALL THE LANDS AROUND EC AND PART OF EC ARE ALL ZONED R THREE. OBVIOUSLY THAT'S PROBABLY NOT THE VISION OF, OF THE TOWN OF HAVING APARTMENT BUILDINGS AND OTHER THINGS THAT AN AREA COULD BE USED FOR OTHER THINGS. SO, UM, BUT THOSE ARE THE CONVERSATIONS THAT HAVE TO OCCUR WITH THE COUNTY AND THE STATE AND EVERYBODY ELSE. BUT WE NEED TO BE AT THE TABLE. THIS IS RICHARD PARK IS PROBABLY SAYING THE SAME THING BEING SITTING AT THE TABLE. UM, ALSO IN YOUR PACKET, UM, I HAVE A COPY OF THE MIXED USE ZONING DISTRICT THAT THE PLANNING BOARD WAS WORKING ON. SO YOU WOULD ESTABLISH A MIXED USE DISTRICT. ONLY YOU, THE TOWN BOARD COULD REZONE PROPERTIES ON YOUR OWN OR AT THE REQUEST OF AN APPLICANT TO REZO THOSE PROPERTIES.
