WE'RE GONNA HEAR FROM KEN TON, SUPERINTENDENT PUBLIC WORKS ON A COUPLE PROJECTS. WE'RE GONNA HEAR FROM CHIEF EZ AT 6 0 5 AND THEN AT SIX 15 WE'RE GONNA MOVE INTO INTERVIEWS FOR PLANNING BOARD MEMBERS. UM, AND WE ALSO HAVE, UH, A COUPLE ISSUES TO ADDRESS AN EXECUTIVE SESSION. SO WE'LL START WITH KIM, A HOT SEAT EVENING. OKAY, I WILL TRY TO MOVE THROUGH THIS QUICKLY 'CAUSE IT'S A LOT OF INFORMATION. UM, SO LATE LAST YEAR, UH, THIS ADVISOR'S REQUEST, I STARTED MEETING WITH THE GROUP THAT IS INTERESTED IN THE WATER TOWER AND THE POTENTIAL FOR THE HAMBURGER MURAL. UM, FROM THAT POINT I STARTED DOING SOME RESEARCH ON THE WATER TOWER AS WELL AS SOME OF THE INFORMATION THAT THEY PROVIDED. I ALSO DID A SITE VISIT WITH THEIR COATINGS EXPERT AND HAVE GATHERED KIND OF A SLEW OF INFORMATION THAT I COULD ON THE WATER TOWER. AND I'M GONNA JUST RUN THROUGH THAT AS QUICKLY AS I CAN AND THEN GET INTO A LITTLE BIT NEXT STEPS AND RECOMMENDATIONS. SO AS YOU'RE ALL AWARE, THE TOWN HAS THIS LARGE WATER TANK OFF HOWARD ROAD CAN BE SEEN FROM THE THROUGHWAY. UM, IT IS NOT IN SERVICE. UH, THE TOWN'S WATER SERVICES WITH ERIE COUNTY WATER AUTHORITY WAS DETERMINED AT ONE POINT THAT THE WATER TANK WAS NOT A NECESSARY PART OF THE DRINKING WATER SYSTEM, BUT IT REMAINS A LARGE STRUCTURE THAT THE TOWN HAS OWNERSHIP AND RESPONSIBILITY OVER. SO IN RESEARCHING THE TOWER, UM, I FOUND SOME REPORTS ON THE TOWER ITSELF IN JANUARY OF 93. SO 20 YEARS. THERE WAS A FULL INSPECTION DONE OF THE TOWER AND I HAVE THAT REPORT AND IT'S 45 PAGES OR SO. UM, I DID NOT INCLUDE IT, BUT IF ANYONE WOULD LIKE TO SEE IT, UH, I HAVE IT ELECTRONICALLY SO I CAN, UH, SPREAD IT TO THE BOARD SO EVERYONE COULD TAKE A LOOK. THE BASIC REQUIREMENT RECOMMENDATIONS OF THIS REPORT WAS TO REDO THE COATING ON THE INTERIOR OF THE TANK, REDO THE COATING ON THE EXTERIOR OF THE TANK, AND SOME MINOR REPAIRS. NOW, THIS WAS 20 YEARS AGO. I WAS NOT ABLE TO FIND ANY EVIDENCE IF ANY OF THAT WAS EVER DONE. THE ONE NOTE IS, OF COURSE, INTERIOR COATING OF THE TANK IS FOR TO MEET DRINKING WATER STANDARDS. OBVIOUSLY THE TANK IS NOT IN SERVICE FOR DRINKING WATER USE. SO, UH, TAKE THOSE RECOMMENDATIONS, THAT GUESS WITH A GRAIN OF SALT. SO FROM THERE, THE UH, GROUP, UH, SORRY, OFFICIAL NAME THE WATER TOWER. THE WATER TOWER GROUP. OKAY. THE WATER TOWER GROUP WAS ABLE TO FIND SOME INFORMATION. UH, THEY DID INCLUDE A REPORT FOR WHEN THE CELL TOWER ANTENNAS WERE PUT ON THE TANK. THAT WAS BASICALLY AN EVALUATION TO DETERMINE IF THERE WAS ANY CONCERNS ABOUT THE ANTENNAS ADDED WEIGHT. UM, ALTHOUGH THE REPORT DOES SPECIFICALLY STATE THAT IT WAS NOT A FULL STRUCTURAL EVALUATION OF THE TANK, IT STATES THAT THE ANTENNAS DO WILL NOT CAUSE ANY ADDITIONAL STRAIN OR STRESS ON THE TANK, AND THEREFORE ARE APPROPRIATE USE FOR THE TOWER ITSELF FROM THERE . SO WHERE I WANNA GO FROM HERE, UM, THAT FULL INSPECTION THAT WAS DONE 20 YEARS AGO. IF THIS WAS AN ACTIVE WATER TANK, THE MOST MANUFACTURERS RECOMMEND THAT TYPE OF INSPECTION EVERY THREE TO FIVE YEARS. PROBABLY IN A MORE PRACTICAL SENSE, YOU SEE THESE TYPES OF INSPECTIONS AT A MINIMUM EVERY 10 YEARS. ERIE COUNTY WATER AUTHORITY CURRENTLY DOES THEM FOR OBVIOUSLY MULTIPLE TANKS AND THEY COST 30 TO $40,000 TO DO THESE INSPECTIONS. BECAUSE THIS IS AN INACTIVE TANK. AN INSPECTION LIKE THAT WOULD BE A SLIGHTLY LESS COST BECAUSE THE INTERIOR IS NOT REALLY A CONCERN FOR THE [00:15:01] TOWN OF PAMPER. BUT THERE IS A SIGNIFICANT COST ASSOCIATED WITH DOING INSPECTION AT THIS TIME. I'M NOT RECOMMENDING THAT INSPECTION BECAUSE I THINK IT'S GOING TO GIVE THE EXACT SAME RESULTS TO THE CURRENT INSPECTION THAT WE HAVE ON FILE. IT'S GONNA STATE THAT YOUR TANK NEEDS EXTERIOR COATING WORK, WHICH LEADS US KIND OF INTO WHERE WE HAVE BEEN WHEN TALKING WITH THE THE WATER TOWER GROUP WHEN WE FIRST STARTED TALKING ABOUT THIS, A FULL COATING OF A TANK LIKE THIS, A TANK THIS AGE HAS LEAD PAINT, WHICH IS THE BIG ISSUE WHEN YOU DO A FULL REC COATING. YOU HAVE TO STRIP THAT LEAD PAINT, THEREFORE YOU HAVE TO TARP AND ENCAPSULATE THE ENTIRE WATER TOWER IN ORDER TO PROTECT, UH, ADJACENT RESIDENTS AND NEIGHBORHOODS FROM THIS LEAD PAINT EXPOSURE. THE LAST TIME GHD DID ONE OF THESE, WHICH BID OUT IN JUNE, 2020, IT WAS $1.6 MILLION TO DO A WATER TOWER WITH THAT HAD LEAD PAINT. THIS WAS A BIG CONCERN WHEN WE, I FIRST STARTED HEARING ABOUT THE WATER TOWER HERE WORKING WITH THE TOWN. SO THE WATER TOWER GROUP STARTED LOOKING AT OPTIONS. THEY STARTED WORKING WITH A COATING EXPERT WHO HAS MANY YEARS IN THE BUSINESS, INCLUDING WORKING WITH SHERMAN WILLIAMS ORIGINALLY. NOW HE'S AN INDEPENDENT, UM, UH, COMPANY OWNER AND TALKING ABOUT AND OVERCOAT SYSTEM AS OPPOSED TO DISTURBING THIS LEAD PAINT AND CAUSING ALL THE NEED FOR ALL THIS ENCAPSULATION. SO GOING BACK TO THAT 93 REPORT, THERE'S ACTUALLY A RECOMMENDATION IN THERE FOR THREE OPTIONS TO DO THE EXTERIOR OF THE TANK, ONE OF WHICH IS AN OVERCOAT SYSTEM IN ORDER TO KEEP THE BASE COAT OR LEAD PAINT UNDISTURBED. SO THAT IS IN LINE WITH WHAT WE ARE SEEING IN THOSE PREVIOUS REPORTS. SO THE, UH, BRUCE STUTZ WAS THE EXPERT THAT THEY'RE WORKING WITH, WENT OUT TO THE SITE AND I ACTUALLY WENT WITH HIM AT THE SAME TIME TO TAKE A LOOK AT THE TANK MYSELF. HE DID AN ADHESION TEST AND THAT IS THE REPORT THAT AL HAVE, UH, FROM THE WORK SESSION, UH, DOCUMENTS STATING THAT THIS TANK PHYSICALLY TESTING PORTIONS OF THE TANK TO MAKE SURE THAT THIS OVERCOAT SYSTEM ACTUALLY WOULD WORK AND IT WOULD ACTUALLY ADHERE TO THE TANK. IT DID THE REPORT, UH, LISTED AS A VERY STRONG CANDIDATE FOR THIS TYPE OF SYSTEM. THE INITIAL COST ESTIMATES ON THAT SYSTEM FROM, AND THEY'RE FROM 2021, WAS 350 TO $450,000. SO A SIGNIFICANT DECREASE FROM THE 1.6 THAT WE'RE SEEING, UH, IN THE CURRENT INDUSTRY. NOW IT IS 2021 NUMBERS. WE ALL KNOW THAT COSTS HAVE INCREASED. SO, UH, I WOULD LEAN MORE ON THE HIGH END OF THE FOUR 50 END FOR THAT TYPE OF PROJECT. THE GROUP ALSO GOT SOME QUOTES TO DO ADDITIONAL STUDIES ON THE TANK, SPECIFICALLY A STRUCTURAL INTEGRITY STUDY, UM, WHICH WAS COST IN 2018 AT $7,300. AND THE REASON THAT I BRING THAT UP WAS, MY ONE CONCERN WHEN IT CAME TO THE OVERCOAT WHEN I MET WITH BRUCE OUT ON THE SITE WAS WE STARTED TALKING ABOUT ACCESSIBILITY AROUND THE TANK BECAUSE YOU HAVE TO OF COURSE GAIN ACCESS TO ALL SIDES AS WELL AS TO GET UP ON TOP. UH, HE FELT THAT BASED ON THE LAYOUT. NOW HE IS NOT A COATINGS CONTRACTOR. HE WORKS IN COATINGS. HE DID SPEAK TO SOME COATING CONTRACTORS THAT HE HAS WORKED WITH TO GET THEIR INPUT. THERE IS A LITTLE BIT OF LIMITED ACCESS ON THE SITE ON TWO SIDES BECAUSE WE HAVE THE RESIDENCE ON HOWARD AS WELL AS THE THROUGHWAY ON THE OTHER SIDE. AND YOU CAN KIND OF SEE THE FENCE LINES IF YOU EVER GET OUT TO THE SITE. OTHERWISE, ACCESS IS ACTUALLY PRETTY CLEAR AROUND THE TANK. THE CONCERN WAS THAT BRUCE HAD MENTIONED THE POSSIBILITY OF A CONTRACTOR WANTING TO DO A LIFT SCAFFOLDING OR HANGING SCAFFOLDING ON THOSE SIDES TO BE ABLE TO ACCESS ALL THE COLUMNS AND PORTIONS OF THE TANK. MY CONCERN WAS THE STRUCTURAL INTEGRITY OF THIS TANK. WE DON'T HAVE ANYTHING ON FILE THAT IS MORE RECENT THAN 93 AND IT REALLY DOESN'T COVER A GREAT DEAL ON THE STRUCTURAL, UM, STRUCTURAL INTEGRITY OF THIS TANK. SO WE TALKED A LITTLE BIT ABOUT OPTIONS. THE TOWN COULD CONSIDER HAVING THIS KIND OF STRUCTURAL INTEGRITY, UH, INSPECTION WORK DONE BY PROFESSIONAL ENGINEER. THE OTHER OPTION WOULD BE THAT IN DOING AN OVERCOAT SYSTEM, YOU COULD PUT THE SAFETY RESPONSIBILITY ON THE CONTRACTOR IS SIMILAR TO THE FACT THAT MEANS AND METHODS REALLY ARE ON THE CONTRACTOR. BRUCE HAD ONE CONTRACTOR WHO THOUGHT HE MIGHT BE ABLE TO WORK WITH JUST, UH, LIFT SCAFFOLDINGS OR, OR A, UM, A MAN LIFT AROUND THE TANK AND MIGHT NOT NEED TO HAVE THIS SORT OF HANGING SCAFFOLDING SYSTEM. IF A CONTRACTOR IS ABLE TO MEET THAT UNDER A CONTRACT, THEN THERE REALLY WOULD BE NO SAFETY CONCERNS FROM UH, MY PERSPECTIVE. BUT THAT WAY THE CONTRACT COULD BE BASICALLY WRITTEN UP TO SAY, IF YOU FIND NEED TO USE THE TANK FOR STRUCTURAL SUPPORT, IT'S UP TO YOU TO EVALUATE THE STRUCTURAL VERY GRITTY OF THE TANK. [00:20:01] AND THE REASON THAT I TALK ABOUT KIND OF CONTRACT LANGUAGE IS NOW BASED ON MY DISCUSSIONS WITH THE GROUP, I FEEL AS YOUR TOWN ENGINEER THAT I WOULD RECOMMEND THE TOWN LOOK INTO DOING THE OVERCOAT OF THE EXTERIOR OF THIS TANK. IT IS A LARGE STRUCTURE CONSTANTLY, UM, BEATEN BY THE ELEMENTS AND WEATHER. IF YOU LOOK AT IT RIGHT NOW, THERE ARE CLEAR INDICATIONS THAT THAT CURRENT EXTERIOR COATING IS STARTING TO WEAR. YOU DO NOT WANNA GET TO A POINT WHERE IT STARTS TO DAMAGE THIS STEEL STRUCTURE OR YOU HAVE TO HAVE ANY SAFETY CONCERNS. THE WAY YOU DO THAT IS BY KEEPING A GOOD COAT OF PAINT ON THESE LARGE TANKS. SO SPEAKING WITH THE GROUP ABOUT WHAT THEIR INTENT WAS AS FAR AS THE MURAL, THEIR THOUGHT PROCESS WOULD BE IS IF THE TOWN IS PURSUING CODING THE TANK AND THE TOWN IS ISSUING A CONTRACT, THEY WOULD LIKE TO CONTRIBUTE A PORTION TO GO FROM THE BASIC BLUE AS WHAT I'LL CALL THE TANK AS IT LOOKS RIGHT NOW TO THE HAMBURGER MURAL. AND THEREFORE THEY COULD FUNDRAISE AND, AND HAVE ENOUGH MONEY TO PAY FOR SORT OF A, A AESTHETIC UPGRADE TO THE TANK SINCE THE TOWN WOULD HAVE THE NEED TO DO OVER COATING. THAT IS KIND OF WHERE WE STAND TODAY. MY RECOMMENDATION IS YOUR TOWN ENGINEER IS GOING TO BE FOR THE TOWN TO LOOK AT OVERCODING THIS TANK FOR THE LONG TERM DURATION OF THIS LARGE STRUCTURAL ASSET. THE GROUP IS HERE TONIGHT, RIGHT? ERIC IS REPRESENTING THEM. CHRIS IS ON THE PHONE WITH US. SO THE ONE OPTION THAT WAS DISCUSSED PREVIOUSLY WAS JUST TAKING IT DOWN? YES. TO AVOID THE ONGOING COSTS AND TO UM, YOU KNOW, AVOID LIKE THE COST OF MAINTAINING IT OR IMPROVING IT. UM, IF WE DID THAT, WHAT'S THE DOWNSIDE ON THE CELLULAR ASPECT? WELL, YOU WOULD CERTAINLY LOSE THE REVENUE FROM THE LEASES AND YOU WOULD HAVE, OBVIOUSLY THE CELL ANTENNAS ARE PLACED THERE LARGELY PROBABLY TO COVER THE THROUGHWAY, UH, IN THAT PORTION. SO, UM, CELLULAR COMPANIES TYPICALLY WILL DO, UH, PROPAGATION MAPS AND UM, THEY HAVE A LOT OF MODELS THAT WILL TELL YOU WHERE YOUR WEAK AND STRONG CELL SERVICES ARE. THIS WOULD LIKELY CAUSE A SMALL HOLE SOMEWHERE. UM, THE CELL SERVICE I'M SURE WOULD START LOOKING FOR OTHER OPTIONS, UM, BECAUSE I'M SURE THEY HAVE NEED IN THAT AREA BASED ON PROXIMITY TO BOTH RESIDENTS AND THROUGH WITH. SO THAT WOULD BE A RISK. AND THEN THERE IS COST. OBVIOUSLY DEMO IS, UH, AN EXPENSIVE UNDERTAKING. I DON'T HAVE THE NUMBERS ON THAT, BUT I KNOW THAT SALVAGE VALUES USED TO HELP OFFSET AND LATELY SALVAGE VALUES HAVE NOT BEEN WHERE THEY HAVE IN PREVIOUS YEARS. UM, SO I COULD PRICE OUT DEMOLITION, SPEAK TO SOME CONTRACTORS. I AM ASSUMING THAT WE ARE STILL TALKING A MILLION DOLLARS OR MORE FOR A DEMO OF THAT WATER TANK BECAUSE OF THE HIGH RISK AND, UH, ELEVATED, UH, WORK. OKAY. HOW OFTEN ARE YOU ANTICIPATING WE'RE GONNA HAVE TO PAY TO HAVE THIS PAINTED? 'CAUSE IT SOUNDS LIKE IT'S GOING TO COST US TO PAINT IT A HALF MILLION. MM-HMM . JUST WONDERING HOW OFTEN WE'RE GONNA HAVE TO GO OUT THE HALF A MILLION VERSUS PAY THE MILLION AND BE DONE. I WOULD THINK THAT IF THIS WAS AN ACTIVE TANK IN A MINIMUM OF 10 YEARS, YOU'D HAVE IT INSPECTED AND THEN YOU'D LET THE EXPERTS TELL YOU WHAT THE COATING CONDITION WOULD BE. THIS IS NOT AN ACTIVE TANK, SO I, IT IT'S HARD TO PUT WHAT USUALLY IS INDUSTRY STANDARD TO A TANK THAT IS NOT CURRENTLY FUNCTIONING. RIGHT. BECAUSE IN INDUSTRY STANDARDS TOO, YOU'RE PROBABLY NOT PAINTING A MURAL THAT YOU WANTED TO MAINTAIN ITS VIBRANCY. RIGHT. AND NOT LOOK SUNDANCE. YOU WOULD SUN WARM. YOU WOULD LIKELY NEED TO HAVE THE TANK AT LEAST LOOKED AT AT THE 10 YEAR MARK. UM, I WOULD NOT THINK THAT IT WOULD TAKE RECODING FOR AT LEAST 20 YEARS. UM, WE COULD ALSO SPEAK TO THEIR COATINGS EXPERT. HE MIGHT HAVE A BETTER IDEA OF THE LONGEVITY OF THOSE, UM, THOSE COATINGS, UM, BEING APPLIED. YEAH, I WOULD WANNA KNOW THAT, ESPECIALLY WITH THE VIBRANCY OF IT BECAUSE OF [00:25:01] ITS BASIC BLUE, THE BASIC BLUE FADES, IT'S MM-HMM LIGHTER, BASIC BLUE, IT'S LIGHTER, BASIC BLUE FADE. UM, SO THIS WOULD BE MORE OF JUST THIS TOWN WANTING TO OCCASIONALLY CHECK IT AS AN ASSET AND AS A, A LARGE STRUCTURE THAT ALWAYS HAS SOME SLIGHT RISK. WOULD THAT ALL BE DONE BY THE WATER AUTHORITY? NO, THAT'S DONE BY THE TOWN. OKAY. AT THIS POINT IT'S THE TOWN'S ASSET. SO THAT, SO THAT 35, 30 TO $40,000 FEE, UH, UH, THAT YOU MENTIONED EARLIER IN TERMS OF THE INSPECTION WOULD NOT BE APPLICABLE GOING FORWARD? NO, BECAUSE THAT IS WHAT THE WATER AUTHORITY CURRENTLY, THEIR LATEST CONTRACT FOR DOING INSPECTIONS OF THEIR ACTIVE TANKS IS WHAT THEIR PRICING OUT IS RIGHT NOW. AND AGAIN, EVEN THE WATER AUTHORITY TOLD ME THAT AS AN INACTIVE TANK, YOU WOULD NOT DO THE DETAILED INSPECTION AND PROBABLY HAVE SOME SAVINGS. BUT AGAIN, I I I DON'T WANT THE TOWN SPENDING MONEY TO GET THE SAME ANSWER WE GOT 20 YEARS AGO, WHICH IS RECODE. AND IT'S NOT REQUIRED NOW BECAUSE IT'S INACTIVE? NO, THAT'S, IT'S NOT REQUIRED. PERFECT. IT'S PURELY FOR THE TOWN'S BENEFIT. SO IN TERMS OF ONGOING EXPENSE, IT WOULD REALLY JUST BE PAINTING THE WATER TOWER? YES. YES. AND THEN AGAIN, AT 10 OR 20 YEARS, YOU MAY WANNA HAVE AN EXPERT CHECK THE COATING FOR ITS CONDITIONS. IT WOULD GIVE YOU THEN AN IDEA OF HOW MUCH IT'S WEARING OVER TIME. THIS WAS 93 WAS THE LAST 93. AND WE HAVEN'T PAINTED IT FOR 30 YEARS. I, IF WE DID IT, IT HAS LASTED 30 YEARS. BUT YOU CAN SEE, I MEAN, THE NEXT TIME YOU JUST DRIVE THROUGH THE AREA, UM, YOU CAN SEE SORT OF A BROWNING. NEW YORK CITY. NEW YORK CITY HAS AN ELABORATE CAMERA SYSTEM. SO WITH THE LICENSE PLATE READERS ON THE CARS, AS THEY'RE DRIVING UP AND DOWN THE ROAD, THE CAMERA CATCHES SNAPSHOTS OF LICENSE PLATES. AND IF THOSE LICENSE PLATES ARE IN THE NCIC SYSTEM, THE NATIONAL CRIME INFORMATION, UM, CENTER, IT WILL CAUSE AN ALERT TO THE DRIVER THAT WHETHER IT'S STOLEN OR IT'S, UM, SOMEONE THEY'RE LOOKING FOR, SOMEONE HAS A WARRANT OR IT'S A MISSING PERSON. SO ON THE CARS, THEY'RE OKAY AND THEY WORK. THE PROBLEM IS IF THE CAR'S NOT ON THE ROAD, WE'RE NOT GETTING ANYTHING. AND SECONDLY, IF THE OFFICER IS AT A CALL AND HE'S PARKED IN SOMEONE'S DRIVEWAY FOR AN HOUR OR TWO, OBVIOUSLY THE LICENSE PLATE READER'S NOT WORKING. AND CAPTAIN LABELLE, CAPTAIN OF THE DETECTIVE BUREAU HAS, UH, HAS A LITTLE COMMITTEE AND THEY HAVE DECIDED WHERE THEY WANT TO PLACE THESE CAMERAS. SO I'M HOPING THERE ARE STATISTICS, YOU KNOW, THAT THEY SAY YOU CAN REDUCE STOLEN VEHICLES, YOU CAN REDUCE CRIME. AND I KNOW STATISTICS ARE STATISTICS, BUT I REALLY BELIEVE THAT UTILIZING THESE CAMERAS WILL BE ABLE TO REDUCE CRIME AND ACTUALLY MAKE MORE ARRESTS BA BASED ON THE INVESTIGATIVE TOOL THAT IT PROVIDES. SO I THINK, I THINK THEY'RE A GOOD THING. I HAVE THE LITERATURE HERE. THIS LAW TAKES EFFECT MARCH 1ST, 2023, AND IT WILL AFFECT THE 2024 TAX ROLE. WHAT THE TOWN BOARD DID WAS RAISE THE, UH, INCOME LIMIT, THE UPPER INCOME LIMIT. SO IT HAD PREVIOUSLY BEEN, IF YOU EARNED LESS THAN $16,800, YOU WERE ELIGIBLE FOR THIS EXEMPTION. WE RAISED THAT FROM 16 EIGHT TO 27 9, A SIGNIFICANT INCREASE. THERE'S MANY MORE PEOPLE THAT WILL BE ELIGIBLE FOR THIS PROPERTY TAX EXEMPTION. AND YOU HAVE UNTIL MARCH 1ST OF THIS YEAR TO COMPLETE. YOUR APPLICATION.
