THEY BID 9.8 MILLION AND THEY ENDED UP 3.6 MILLION, OVER 3.6 MILLION. AND THAT RESULTED IN AN AUDIT BY THE NEW YORK STATE COMPTROLLER. THE WEST SENECA TOWN BOARD. NOW, WE'RE FIDUCIARIES HERE ON THIS BOARD, AND THAT MEANS THAT WE HAVE A RESPONSIBILITY TO DO THINGS PROPERLY. SO WHAT I'M ASKING MY COLLEAGUES TO DO IS TO TABLE THIS MOTION OR TABLE THIS BOND RESOLUTION, UNTIL WE CAN INVESTIGATE THIS CONTRACTOR TO MAKE SURE THAT THEY ARE, IN FACT, THE LOWEST BIDDER. NUMBER ONE, BECAUSE THERE'S SOME OTHER BIDS THAT WE RECEIVED. AND IF THIS CONTRACTOR HAS A PATTERN OF UNDERBIDDING TO GET THE JOB RIGHT, IF THEY BID THE LOWEST BUT THEN COST THE TOWN MORE MONEY, WE COULD BE IN SOME PERIL. BUT THEY WENT OVER BUDGET BY 40%, AND THAT RESULTED IN AN AUDIT OF THE TOWN BOARD OF WEST SENECA. AND THAT AUDIT FOUND THAT THE BOARD DID NOT ACT PROPERLY AND THAT THERE WERE OVERRUNS FOR CONSTRUCTION. AND THERE MAY NOT BE ANYTHING NEFARIOUS, BUT I THINK WE OWE IT TO THE CITIZENS TO MAKE SURE THAT IF WE'RE GOING TO RAISE BONDS, WHICH ARE GOING TO RESULT IN TAX INCREASE, THAT WE JUST DO IT THE RIGHT WAY. THERE'S I MEAN, THERE'S NO RUSH TO DO THIS. AND WE AND IF WE'RE GOING TO DO IT, DO IT RIGHT. YOU JUST MADE THE COMMENT THAT IT WAS THE BOARD. I DID EMAIL IT TO ALL THE BOARD MEMBERS, BUT IT WAS PROBABLY JUST BEFORE OUR WORK SESSION TODAY, SO YOU HAVE PROBABLY NOT HAD A CHANCE TO SEE IT, BUT I CAN PULL A LITTLE BIT OF INFORMATION. THE KEY FINDINGS IS THAT THE TOWN BOARD DID NOT PROPERLY PLAN OR MANAGE THE CAPITAL PROJECT, OR CLEARLY INFORM TAXPAYERS WHEN THE ESTIMATED COSTS AND SCOPE OF THE PROJECT CHANGED. THE. IT ALSO SAYS THE TOWN OFFICIALS DID NOT ENSURE AN ITEMIZED PRODUCT BUDGET OUTLINING REVENUES AND EXPENDITURES WAS MAINTAINED. SO WE HAVE ALREADY HAD CONVERSATIONS WITH OUR FINANCE DEPARTMENT ABOUT TRYING TO KEEP TRACK OF THE FINANCES OF THIS PROJECT IN THAT ITEMIZED DETAIL. ALSO, A COUPLE NOTES. IT DOES SAY THAT THE PROJECT CHANGED MULTIPLE TIMES DURING THE PLANNING STAGE TO ADDRESS ISSUES WITH SOME DAMAGED TOWN BUILDINGS, WHICH REQUIRED THEM TO MOVE DEPARTMENTS, WHICH IS WHY THE PROJECT KIND OF STARTED AS A LIBRARY RENOVATION AND BECAME MORE OF A COMMUNITY CENTER, ACCORDING TO THE REPORT. IT [00:25:04] SAYS THAT THE ENGINEER'S PRELIMINARY ESTIMATE WAS 9.8 MILLION, AND THAT WAS PREPARED IN MARCH OF 2016. THEN IN MAY OF 2016, THE BOARD PASSED THEIR BOND RESOLUTION. THEN IN OCTOBER OF 2016, THEY WENT OUT FOR BID. AND SO THE BIDS CAME IN HIGHER THAN THE ENGINEER'S ESTIMATE. AND THE ENGINEER ACTUALLY PRODUCED A MEMO TO THAT TOWN BOARD IN DECEMBER OF 2016, SAYING THAT THE BIDS WERE MORE THAN THE INITIAL ESTIMATE BECAUSE IT WAS MADE PRIOR TO THE ADDITION OF A SECOND STORY OFFICE SPACE AND HIGH CEILING SPACE FOR THE RECREATION DEPARTMENT. SO THE TOWN BOARD HAS BEEN CRITICIZED FOR THE PROJECT FOR POOR PLANNING, IN THAT THEY PASSED A RESOLUTION FOR THEIR BOND BASED ON THE ENGINEER'S ESTIMATE, AS OPPOSED TO WHAT THE BIDS ACTUALLY CAME IN AS. RECITATIVE. THIS IS NOT MENTIONED IN THE REPORT, SO IT SEEMS TO BE THAT IN THE PLANNING AND DESIGN THERE WERE MISCOMMUNICATIONS AND SOME LACK OF TRANSPARENCY SEEMS TO BE THE BIG CONCERN FROM THE COMPTROLLER'S OFFICE. SO CAN YOU COMPARE THAT TO THE PROCESS THAT WAS UTILIZED HERE AND WHAT WE'RE PRESENTED WITH THIS EVENING? SO THE TOWN HAS BEEN WORKING ON THIS PROJECT FOR OVER A YEAR, TWO YEARS AT THIS POINT. THIS IS A NEW PROJECT VERSUS RENOVATION OF AN EXISTING BUILDING. ALSO, WE HAVE NOW OPENED OUR BIDS, SO WE HAVE THE ACTUAL NUMBERS FROM THE CONTRACTORS. I CANNOT SAY THAT THERE WON'T BE ISSUES ALONG THE WAY. WE WILL DIG IN THE GROUND TO PUT IN UTILITIES. YOU NEVER KNOW WHAT YOU WILL FIND, BUT ONE OF THE BIG DIFFERENCE THAT WE HAVE FOUND ON ALL PROJECTS IS THAT WHEN YOU RENOVATE AN OLD BUILDING, THAT IS WHEN YOU DISCOVER A LOT OF ISSUES IN THE OLD BUILDING AND YOU HAVE TO ADDRESS THAT, AND THOSE ARE UNPLANNED THINGS. DURING CONSTRUCTION, THIS APPEARS TO BE UNPLANNED THINGS DURING PLANNING AND DESIGN. SO I DO FEEL LIKE THERE IS A DIFFERENCE BETWEEN THE TWO PROJECTS, BUT I LEAVE IT TO THE BOARD TO CONSIDER. AND WE HAVE WE HAVE ASKED THEM TO FILL OUT A QUESTIONNAIRE ON THEIR EXPERIENCE, THEIR FINANCIAL STABILITY, THEIR PLANT AND LABOR AVAILABILITY. WE HAVE ASKED THEM FOR REFERENCES ON PROJECTS, AND THE TWO ARE SO CLOSE. IT ONLY COMES DOWN TO A SMALL PRICE DIFFERENCE. AND HAVE YOU HAD DIFFICULTY GETTING INFORMATION FROM THE LOWEST BIDDER? WHEN YOU ASK FOR FURTHER DETAILS, CLARIFICATION, SUPPORTING DOCUMENTATION IN A IN A SHORT PERIOD OF TIME SINCE OUR BID OPENING, I HAVE ASKED THEM MULTIPLE QUESTIONS AND THEY HAVE RESPONDED REGULARLY AND THEY GAVE US A LIST OF REFERENCES AS WELL. THEY DID. DID THEY LIST WEST SENECA AS ONE? THEY DID LIST WEST SENECA AS A SIMILAR PROJECT, PROBABLY DUE TO THE SIZE AND SCOPE. THE BIGGEST DIFFERENCE BEING THAT THERE WAS A RENOVATION INVOLVED IN WEST SENECA. AND THERE WILL NOT BE BECAUSE THIS IS ALL A NEW BUILDING. SURE, THEY DID ADD ON TO THE WEST SENECA. IT DOES SEEM LIKE WEST SENECA MADE A LOT OF DECISIONS ALONG THE WAY TO ADD THINGS AND CHANGE THINGS DEPENDING ON WHAT DEPARTMENTS THEY WANTED TO MOVE INTO, WHAT SPACE THEY EVEN MY UNDERSTANDING, AT LEAST AT THE TIME OF THIS REPORT, WHICH IS SEVERAL YEARS OLD, THEY EVEN LEFT SOME LIKE UNCOMPLETED OFFICE SPACE TO POSSIBLY RENOVATE IN THE FUTURE FOR DEPARTMENTS. IT QUICKLY BECAME APPARENT THAT A LEASE WAS NOT GOING TO AFFORD US THE OPPORTUNITY TO REALLY BE IN CONTROL OF THE FINANCES, TO BE IN CONTROL OF THE PHYSICAL MAINTENANCE OF THE FACILITY, AND THAT IF WE WANTED TO BE ABLE TO HAVE THAT CONTROL, WHICH WOULD ALLOW US TO BE MORE ACCOUNTABLE TO THE TAXPAYERS AND TO BE ABLE TO PLAN AND WE LEARN, YOU KNOW, GOING THROUGH THIS WITH OUR FINANCE DIRECTOR AND HOW IMPORTANT IT IS TO BE ABLE TO PREDICT THESE COSTS AND BE ABLE TO PLAN FOR IT. I ALSO WANTED TO HIGHLIGHT A YOUNG LADY BY THE LAST NAME OF ARRINGTON THAT LIVES IN THE TOWN OF HAMBURG, THAT IS A GIRL SCOUT, AND WENT ABOVE AND BEYOND TO EARN. I BELIEVE IT WAS HER SILVER APPLE AWARD BY SETTING UP THREE PET PANTRY LOCATIONS THROUGHOUT THE TOWN. IT WAS FANTASTIC TO SEE OUR YOUTH DOING SOMETHING INCREDIBLE. I JUST SPOKE TO HER MOM YESTERDAY AND SEVERAL OF THE PANTRIES. THEY'VE HAD TO REPLENISH THEM MULTIPLE TIMES, SO THERE IS DEFINITELY A NEED WITHIN THE TOWN. SO IF YOU FEEL CALLED OR YOU HAVE EXTRA PET SUPPLIES AT HOME, YOUR DOG JUST DID NOT LIKE THOSE BONES AND YOU BOUGHT THEM ON SALE. YOU CAN ADD THINGS TO THE PET PANTRY ALONG WITH THE ONES THAT SHE ALREADY HAS DONATED. THERE'S LOCATIONS AT THE VFW POST IN LAKEVIEW, THE LIBRARY IN THE VILLAGE, AND THERE'S A THIRD LOCATION I BELIEVE IN BLASDELL. SO PLEASE, THE MOMENT YOU THINK NOBODY ELSE IS TRYING AND NOBODY ELSE CARES ABOUT THE TOWN, THE KIDS DEFINITELY CARE. JUST LIKE THE YOUNG MAN WHO IS HERE TODAY. THIS IS A FRESHMAN IN HIGH SCHOOL THAT WENT ABOVE AND BEYOND, AND THAT'S ALL I HAVE FOR NOW. OKAY, WELL, VERY QUICKLY, I'LL JUST ALSO SAY THANK YOU TO THE HISTORIC PRESERVATION. RECENTLY, YOU MIGHT HAVE SEEN A SPEED REDUCTION ON ROUTE FIVE, FOR EXAMPLE. THEY WORK WITH AND THAT IS A STATE ROAD, BUT THEY WORK WITH OUR PARTNERS AT THE STATE AND WITH THE COUNTY. THEY WORK WITH OUR POLICE DEPARTMENT ON MANY DIFFERENT INITIATIVES. THEY'RE INVOLVED WITH THE CLARK AND MCKINLEY INTERSECTION CURRENTLY, AND THEY'RE ALSO DOING WORK ON LAKE AVENUE WITH THAT CROSSWALK. THEY ALSO FREQUENTLY WILL ADVOCATE FOR THE RESIDENTS OF THE TOWN, AND THEY'RE CURRENTLY PUTTING A LETTER AND WORKING WITH MR. GIACOMINI. WE'RE PUTTING A LETTER TOGETHER TO ONCE AGAIN GO OUT TO THE STATE. THERE'S A COUPLE OF KEY AREAS THAT WE HAVE FOR YEARS PETITIONED THE STATE FOR TO TAKE A LOOK AT, AND THAT INCLUDES AT HOWARD AND CAMP, THAT WHOLE STRETCH OF CAMP AND SEVERAL OTHER AREAS. SO WE'RE GOING TO BE PETITIONING THE STATE AGAIN. YOU KNOW, WE WAIT A FEW MONTHS AND THEN WE WE CIRCLE BACK AND TRY ONCE MORE. WE HAD HOPED THAT WITH THE ADDITION OF FEEDMORE AND CAMP ROAD, THAT THE LAST TIME WE ASKED, IT MAY HAVE BEEN A POSITIVE RESPONSE, BUT WE'RE GOING TO CIRCLE BACK AND WE'RE GOING TO KEEP KEEP ASKING. I'D LIKE TO THANK THE MANY DIFFERENT TOWN EMPLOYEES WHO HELP ALL THE TIME WHEN WE HAVE PUBLIC ENGAGEMENT OPPORTUNITIES, AND WE HAVE INCREASED THAT IN THE YEARS THAT I'VE BEEN HERE. WE ONE THING THAT I THINK IS VERY IMPORTANT IS TO HEAR FROM THE PUBLIC. AND WE HAVE A LOT OF PUBLIC ENGAGEMENT OPPORTUNITIES WHENEVER WE HAVE A STUDY, WHENEVER WE HAVE A PROJECT, SOMETHING THAT WE ARE DOING MORE AND MORE OF RECENTLY IS AS WE HAVE THESE ZONING CHANGES THAT HAVE COME OUT OF OUR COMPREHENSIVE PLAN AS WE'RE PUTTING THEM INTO PLACE, SO THAT THAT DOCUMENT JUST DOESN'T SIT ON A SHELF. AND WE'RE MAKING ALL OF THE IMPROVEMENTS THAT THE COMMUNITY IS ASKING FOR, THAT WHEN THOSE ITEMS COME UP FOR A PUBLIC HEARING, OUR PLANNING DEPARTMENT STAFF IS HERE. THEY COME EARLY, THEY COME FOR ABOUT AN HOUR SO THAT ANY COMMUNITY MEMBERS CAN COME AND GET FURTHER INFORMATION. THEY CAN TALK, THEY CAN LEARN, THEY CAN UNDERSTAND. IT'S REALLY IMPORTANT THAT OUR PUBLIC, THAT OUR RESIDENTS, OUR TAXPAYERS REALLY UNDERSTAND AND GIVE US INPUT. THAT'S HOW WE'RE ABLE TO CRAFT ALL OF THESE CHANGES AND IMPROVE THEM. WHEN WE HAVE STUDIES LIKE OUR BOA, WE HAD INFORMATION FROM THE PUBLIC FROM YEARS AGO. NOW THAT IT'S GETTING NEAR THE END OF THE STUDY, WE HAD ANOTHER THE THIRD PUBLIC MEETING, AND WE HAD SOME ADDITIONAL INFORMATION. SO WE'RE GOING TO CIRCLE BACK TO THE STUDY AND MAKE SURE THAT THAT'S INCORPORATED IN THE PUBLIC ENGAGEMENT. YOUR INPUT IS IS VITAL AND IS TRULY A PART OF OUR ONGOING PROCESS AS WE LOOK AT EVERYTHING AND MAKE MAKE IMPROVEMENTS. SO THANK YOU TO ALL OF THAT. THERE WERE TENTS, OUR YOUTH AND SENIOR SERVICES STAFF, THEY WERE THERE AS ALWAYS, OUR HAMBURG POLICE, THEY WERE THERE. IT WAS THE FIRST TIME IT'S EVER BEEN DONE IN NEW YORK STATE. FIRST TIME EVER IN NEW YORK STATE. THE THE STANDS WERE PACKED BEFORE THE GIRLS EVEN STARTED TO PLAY. IT WAS JUST ANOTHER GREAT EXAMPLE OF OUR COMMUNITY COMING TOGETHER, WORKING TOGETHER, MULTI-GENERATIONAL, OUR YOUTH, OUR SENIORS, OUR TEACHERS.
