I KIND OF JUST WANTED TO GO OVER THAT A LITTLE BIT IN DETAIL. OBVIOUSLY, I HELP OUT WITH THE PLANNING BOARD AND KIND OF WANT TO GIVE YOU THEIR THOUGHTS AND ALSO SHOW KIND OF A SHOW OF THE EXISTING ZONING EVERYONE SHOULD HAVE ON THE BOARD. I ALSO WANT TO POINT OUT THAT IF YOU LOOK AT THE INTERSECTION RIGHT AT MCKINLEY PARKWAY, WHERE THE SEVEN CORNERS USED TO BE, THERE'S A PARCEL THAT C2 RIGHT NOW WHERE IF THIS DEVELOPER HAD BOUGHT THAT PIECE OF PARCEL, IT WOULDN'T EVEN BE BEFORE THIS BOARD. IT WOULD JUST GO TO THE PLANNING BOARD FOR A SPECIAL USE PERMIT. BUT BECAUSE THEY WANTED TO HAVE A LARGER PARCEL, THAT'S WHY THEY'RE BEFORE YOU. ANY COMMERCIAL USES THAT WOULD GO AT THIS INTERSECTION SHOULD JUST PROTECT THE SURROUNDING RESIDENTIAL AREAS THAT ARE AROUND, AND SHOULD JUST TAKE INTO ACCOUNT THE EXISTING TRAFFIC ISSUES AND PLAN FOR MITIGATIONS FOR THOSE. WE ALSO THEN TALKED ABOUT THE HISTORY OF THE SITE. I BELIEVE AT THE LAST MEETING WE TALKED ABOUT, THERE HAVE BEEN A COUPLE PROPOSALS IN THIS AREA FOR SIMILAR KIND OF USES, ALL OF WHICH HAVEN'T COME TO FRUITION, BUT THAT THIS IS, LIKE I SAID, A COMMERCIAL AREA IN NATURE. AND THEN THE RECOMMENDATION FROM THE PLANNING BOARD WAS THAT THE PLANNING BOARD DID RECOMMEND A NEGATIVE DECLARATION WITH A NUMBER OF CONDITIONS. OBVIOUSLY, WITH A GAS STATION COMPONENT, THERE'S AN ENVIRONMENTAL FEATURE THAT GOES TO THAT, WHICH I KNOW A LOT OF PEOPLE HAVE HAD A CONCERN ABOUT. THE NEAREST RESIDENTIAL NEIGHBORHOOD IS BROOK PARKWAY, WHICH IS IN KIND OF THE NORTHWESTERN SECTION OF THIS AREA. I KNOW ON THE SITE PLAN FOR THIS PROJECT, THE APPLICANT HAS PROPOSED THE GAS STATION THE FURTHEST AWAY POSSIBLE FROM THAT RESIDENTIAL AREA CLOSEST TO SOUTHWESTERN. WHEN THEY DO THEIR PRESENTATION, I'M SURE THEY'RE GOING TO TALK ABOUT THERE WAS A QUESTION ABOUT CURB CUT ACCESS AND WHERE THEY WERE GOING TO HAVE CURB CUTS, WHETHER IT WAS OFF TO SOUTHWESTERN, WHETHER IT WAS OFF OF BIG TREE, WHETHER IT WAS OFF OF BOTH. IF YOU GUYS, AS YOU GUYS KNOW, WE'VE HAD A NUMBER OF PROJECTS IN THE PAST WHERE DOT ON THEIR STATE HIGHWAY SYSTEM DOESN'T LIKE NEW CURB, NEW CURB CUTS THROUGH MY INTERACTION WITH THE APPLICANT, YOU KNOW, THEY'VE BEEN IN CONTACT WITH DOT. THEY HAVEN'T GIVEN A HARD NO, WHICH I THINK IS A LOT OF PROGRESS FROM BEFORE, BECAUSE A LOT OF TIMES DOT IS LIKE ABSOLUTELY NO CURB CUTS ONTO THEIR STATE HIGHWAY SYSTEM. AND THEN AS YOU CAN SEE IN THE ADVISORY REPORT, THE PLANNING BOARD DOES TALK ABOUT, YOU KNOW, AN ADEQUATE LANDSCAPE BUFFER. IF THIS TOWN BOARD DOES GO FORWARD WITH THIS, REZONING WOULD DEFINITELY BE NEEDED. THEY TALKED ABOUT REQUIRING OR ASKING THE PLANNING THE APPLICANT TO PROVIDE A TRAFFIC FLOW OR CIRCULATION STUDY TO KIND OF TALK ABOUT THOSE TRAFFIC MITIGATIONS, BUT THEY ALSO WANTED TO NOTE THAT THEY DON'T BELIEVE THAT THE BILLS STADIUM COMING UP AND BILLS GAME DAY AND BILLS TRAFFIC SHOULD BE AN IMPEDIMENT THAT THAT TRAFFIC FLOW AND THAT CIRCULATION STUDY SHOULD INCORPORATE IT. SHOULD THIS BOARD APPROVE THIS PROJECT AND APPROVE THIS THIS REZONING. SO I KIND OF WANTED TO JUST GIVE A VERY BRIEF OVERVIEW OF WHAT HAPPENED AT THE PLANNING BOARD LEVEL. NUMBER ONE, THE UNDERGROUND STORAGE TANKS DO NEED TO BE REGISTERED WITH THE DEC PURSUANT TO SIX NYC PART 617 OR 612 THROUGH 614 AND FIVE 8098 THROUGH 99. ANY TANK WHICH WILL INCLUDE MORE THAN 1100 GALLONS OF FUEL STORAGE DOES REQUIRE THAT. OBVIOUSLY, WE'RE AWARE OF THAT. WE WILL ALSO HAVE TO HAVE APPROPRIATE ENGINEERING CONTROLS, INCLUDING LEAK DETECTION, MONITORING SYSTEMS, OPERATOR TRAINING, AND THEN REGULAR INSPECTIONS. AND THAT INSPECTION PAPERWORK DOES NEED TO SUBMITTED TO THE OR TO THE DEC. NUMBER TWO, THERE WILL BE DOUBLE WALLED TANKS. I WAS ALSO THERE JUST TO ANSWER QUESTIONS ABOUT THE PROCESS, BECAUSE THERE WERE SOME NEIGHBORS WHO HAD QUESTIONS ABOUT THE PROCESS FOR THE PROJECT ITSELF. IT'S PROPOSED AS A TWO MEGAWATT PROJECT. AND I ENCOURAGE EVERYONE TO TAKE A LOOK. AND SO, AGAIN, HE'S AN EXAMPLE OF A COMMUNITY MEMBER WHO CHOSE TO GIVE BACK TO SOMETHING THAT REALLY IS A GEM AND THAT WE SHOULD BE SO PROUD OF IN OUR COMMUNITY. AND THAT'S PENN, DIXIE AND MR. MORETTI WAS FREQUENTLY SEEN LEADING FIELD TRIPS OR STARGAZING EVENTS, AND HE WAS TOTALLY INVESTED AND ENMESHED IN MAKING SURE THAT DIXIE TRULY WAS THE INCREDIBLE PLACE THAT IT REMAINS FOR STUDENTS AND GRANDPARENTS AND EVERYONE TO COME AND ENJOY.
