OR WHAT HAPPENS IF THE GAS STATION SHOULD FAIL OR A LOT OF CONCERNS. SO WHAT WE DID WAS TALK WITH THIS BOARD ABOUT, YOU KNOW, WHAT KIND OF CONDITIONS THAT THIS BOARD WANTED. WE LOOKED AT THE REZONING REPORT THAT THE PLANNING BOARD PUT TOGETHER. WE WORKED WITH THE APPLICANT ON WHAT CONDITIONS THAT THEY WOULD BE AMENABLE TO. AND WHAT YOU'LL SEE IN THE APPROVAL RESOLUTION FOR THIS PROJECT IS THAT THERE'S A CONDITION THAT THE APPLICANT HAS STATED THEMSELVES THAT IF THEY DON'T GET A RIGHT IN, RIGHT OUT ON SOUTHWESTERN OR ENTRANCE ON THE BIG TREE, THE PROJECT ISN'T EVEN FEASIBLE TO THEM. SO THAT'S CAVEAT [00:25:03] NUMBER ONE. CAVEAT NUMBER TWO IS THAT THERE'S A PROVISION IN THE APPROVAL RESOLUTION THAT SHOULD THIS PROJECT NOT BE CONSTRUCTED WITHIN THREE YEARS OF THE EFFECTIVE DATE OF THIS RESOLUTION, THIS BOARD RESERVES THE RIGHT TO REVIEW THE REZONING AGAIN. SO YOU CAN TAKE A LOOK AT IT. IF IT'S NOT CONSTRUCTED WITHIN THREE YEARS, IT'S CAVEAT NUMBER TWO. AND THEN CAVEAT NUMBER THREE IS THAT THE APPLICANT WAS AGREEABLE TO A PERFORMANCE BOND, WHICH WOULD BE WORKED OUT BETWEEN THE PLANNING BOARD AND THE TOWN ENGINEER RELATED TO THE LANDSCAPING, RELATED TO SOME OF THE STORMWATER FACILITIES, AND THAT THAT AMOUNT WOULD BE WORKED OUT BETWEEN CAMI AS TOWN ENGINEER AND THE PLANNING BOARD. I KNOW MR. KOZUB, THAT WAS ONE OF THE THINGS THAT YOU WERE CONCERNED WITH. SO THAT'S CAVEAT NUMBER THREE. IF THERE ISN'T EVEN AN ENTRANCE ONTO EITHER ROAD, IT'S NOT FEASIBLE TO THE APPLICANT. IF THEY DO GET BOTH ENTRANCES AND THEY DON'T CONSTRUCT IT, THEN THE PLANNING, THEN THE TOWN BOARD HAS THE RIGHT TO RELOOK AT THE REZONING. AND THEN IF THERE'S A QUESTION ON SOME OF THE FACILITIES, IF THEY'RE NOT BUILT UP TO STANDARD, THEN THE PLANNING BOARD HAS THE RIGHT TO RELOOK AT THE REZONING. AGAIN, BECAUSE OF THAT CAVEAT. TWO THE THREE YEAR PERIOD IS THAT THREE YEARS TO BEGIN CONSTRUCTION OR COMPLETE CONSTRUCTION, BE OPERATING BY THREE YEARS OR START CONSTRUCTION BY THREE YEARS. GAS STATIONS ARE A LOT DIFFERENT NOW THAN THEY WERE EVEN IN THE 90S AND EARLY 2000. OBVIOUSLY, THEY'RE REGULATED THROUGH DECC. THE APPLICANT DID PROVIDE ON THE RECORD, WHICH WAS A PART OF THE SECRET DOCUMENTATION, THAT THERE ARE STRINGENT STANDARDS THAT DC HAS TO FOLLOW FOR GAS STATIONS. THERE'S A LEAK DETECTION SYSTEMS. THERE'S A LOT OF MONITORING WHEN IT COMES TO THE UNDERGROUND FUEL TANKS, AND WE'VE PUT IN THE PROVISIONS FOR, LIKE I SAID. SO THAT PERFORMANCE BOND THAT THE TOWN BOARD HAS THE RIGHT TO RELOOK AT THE REZONING SHOULD THINGS IN THE FUTURE, YOU KNOW, NOT WORK, WHETHER IT'S NOT CONSTRUCTED OR WHETHER THERE'S AN ISSUE WITH THE GAS STATION THAT THIS BOARD RESERVES THE RIGHT TO RELOOK AT THE GAS STATION. AND IT MAYBE WENT A LITTLE BIT UNNOTICED, BUT I WOULD LIKE TO BRING ATTENTION TO THE FACT THAT LAST SUMMER, ERIE COUNTY CONTACTED THE TOWN, AND EVERY SO OFTEN WHAT THEY'D LIKE TO DO IS THEY LIKE TO OFFER UP TO THE DIFFERENT MUNICIPALITIES, SMALL PIECES, SMALL PARCELS. SOMETIMES THEY'RE TEN BY 30, TEN BY 80. THEY'RE JUST SMALL, ODD PIECES OF GREEN SPACE. AND SO THEY OFFERED A LARGE LIST OF POSSIBILITIES WITHIN THE TOWN OF HAMBURG. AND WITH THE HELP OF OUR PLANNING DEPARTMENT AND OUR ENGINEERING DEPARTMENT, OUR LEGAL DEPARTMENT, WE WENT THROUGH AND AND HIGHWAY, WE WENT THROUGH THAT ENTIRE LIST. IT WAS SEVERAL HUNDRED LONG THE LIST, AND WE ANALYZED EVERY PARCEL. AND SO WHAT WE DID IS WE SEIZED THE OPPORTUNITY. AND TONIGHT'S RESOLUTION WAS THAT THE COUNTY IS TRANSFERRING OVER 102 OF THOSE PARCELS. IN SOME SITUATIONS IT WAS TO CREATE OR IT WAS TO INCREASE THE RIGHT OF WAY FOR OUR HIGHWAY SUPERINTENDENT. THERE WERE EXAMPLES WHERE IT WAS ON PAPER ROADS AND SO WE DID NOT WANT TO. WE DIDN'T THINK IT FIT INTO OUR COMPREHENSIVE PLAN FOR POSSIBLE DEVELOPMENT THAT COULD COME IN THERE IN OTHER SITUATIONS. IT WAS IN ESTABLISHED NEIGHBORHOODS WHERE IT WAS 1 OR 2 PARCELS HERE OR THERE. WE DECIDED IT WAS MORE IMPORTANT FOR US TO BE ABLE TO RETAIN THAT AS GREEN SPACE. IN OTHER SITUATIONS. THERE WERE PARCELS THAT WERE ADJACENT TO OUR PARKS, AND WE FELT IT WAS IMPORTANT FOR US TO GAIN CONTROL AGAIN, TO PROTECT THAT GREEN SPACE. SO THOSE THAT RESOLUTION THIS EVENING WAS FOR THE TRANSFER OF THOSE 102 PARCELS FROM ERIE COUNTY TO THE TOWN OF HAMBURG [01:45:02] FOR A WHOPPING $1. BUT WE DID THAT. THAT WAS A TEAM EFFORT, AND WE THOUGHT IT WAS IMPORTANT. AGAIN, IT ADDS TO THE OVERALL GREEN SPACE IN THE COMMUNITY. I JUST HAVE A COUPLE OF THINGS. OH, A REMINDER, THE SCHEDULE IS A LITTLE BIT DIFFERENT FOR OUR NEXT TOWN BOARD MEETING. USUALLY YOU'RE USED TO THEM BEING EVERY OTHER WEEK BECAUSE OF THE HOLIDAY. IN MAY, OUR SCHEDULE FOR TOWN BOARD MEETINGS WILL BE ON MAY 4TH AND MAY 18TH. SO WE RETURN NEXT MONDAY, SAME PLACE, SAME TIME FOR A TOWN BOARD MEETING. I ALSO THIS PAST WEEK I HAD THE OPPORTUNITY TO SPEAK TO TWO IMPORTANT GROUPS, ONE IN THE TOWN AND ONE IN THE REGION. THE FIRST WAS. I SPENT TUESDAY MORNING WITH THE SOUTH TOWN'S CHAMBER OF COMMERCE. IT WAS A GREAT TIME FOR ME TO MEET WITH OUR BUSINESS COMMUNITY. SO IMPORTANT, SO VITAL. AND WE TALKED ABOUT THE RELATIONSHIP BETWEEN THE TOWN, OUR BUSINESS COMMUNITY, THE RESIDENTS, WHAT WE COULD WORK ON AND DO TOGETHER. THAT WAS A GREAT EXPERIENCE. AND THEN WEDNESDAY, I HAD THE OPPORTUNITY WITH THE SUPERVISOR OF THE TOWN OF ORCHARD PARK TO SPEAK. WE WERE THE TWO PANELISTS AT THE CONSTRUCTION EXCHANGE, THEIR ANNUAL MEETING. THERE WERE ABOUT 300 PEOPLE THERE, AND WE FOCUSED ON THE BILLS STADIUM AND THE IMPACT TO THE AREAS AROUND THE BILLS STADIUM. WHAT ARE AND I KNOW I'VE WORKED, YOU KNOW, LENGTHY WITH THE COMMITTEE, WITH OUR PLANNING CONSULTANT, ETC. AND WITHIN THE NEXT MONTH, WE WILL BE LOOKING TO FINALIZE OUR PLAN AND OUR ZONING FOR THAT AREA. THE ECC CAMPUS IS CURRENTLY ZONED R-3, WHICH MEANS APARTMENT COMPLEXES. AS YOU'VE HEARD ME SPEAK, YOU KNOW, FOR THE LAST SEVERAL YEARS, WE DON'T WANT THAT LOST ECONOMIC DEVELOPMENT OPPORTUNITY BOTH FOR THE TOWN OF HAMBURG AND FOR THE REGION. SO WE'VE BEEN WORKING VERY HARD TO DEVELOP A PLAN AND A ZONING PACKAGE FOR THAT AREA THAT WILL BE PRESENTED. WE'VE ALREADY HAD PUBLIC ENGAGEMENT, BUT THAT WILL BE PRESENTED FOR ADOPTION SHORTLY.
